This appeal raises a jurisdictional issue of first impression in this circuit: whether we have jurisdiction over an appeal from a magistrate judges final order and judgment when the clerk of the district court invited the parties to consent, through inaction, to the magistrate judges final disposition of their case. Because we find that the parties did not expressly consent to final disposition by a magistrate judge, we dismiss the appeal.
